John Zaccaria manages Notaro, Michalos & Zaccaria P.C.
John represents the firm’s clients in all aspects of intellectual property law.
He handles a wide range of matters including complex negotiations, litigation and the preparation and enforcement of contracts.
John serves as lead attorney in federal court litigations across the nation, expertly handling cases involving patent infringement, trademark infringement, trade dress infringement, copyright infringement, misappropriation of trade secrets, unfair competition, and various other intellectual property matters. Additionally, he has worked with foreign counsel on patent litigations in multiple countries.
He is actively involved in every phase of the litigation process, from pre-litigation investigations through trial. Among other things, John prepares and argues substantive and procedural motions including summary judgment motions and motions for dismissal, trial briefs, discovery requests and responses, jury instructions, and direct and cross examination of witnesses for depositions and trials. John obtains and opposes applications for temporary restraining orders and preliminary injunctions. He negotiates and drafts settlement and release agreements, including consent injunctions, to resolve disputes favorably and efficiently.
John also represents clients in proceedings and appeals before the Patent and Trademark Office, including appeals, opposition and cancellation proceedings. He has represented clients in the arbitration of a significant number of disputes.
John drafts patent and trademark applications, responses to office actions, appeal briefs and patentability and validity opinions. He prepares and responds to cease and desist letters as well as a wide range of intellectual property-related agreements, including but not limited to trademark coexistence agreements, non-disclosure agreements, licensing agreements, and assignments of ownership rights of intellectual property.
