Alan Federbush has over 30 years experience representing clients in many aspects of intellectual property law, including patent and trademark litigation and appeals, mediation and arbitration, patent reexamination, freedom-to-operate investigations, and intellectual property due diligence and transactions.
Alan routinely advocates for our clients in court, administrative, and arbitration conferences and hearings. He has represented the firm’s clients in federal courts throughout the United States, in dozens of opposition and cancellation proceedings before the Trademark Trial and Appeal Board, and in appeals before the Second, Ninth, Eleventh and Federal Circuits. Alan has also represented clients in numerous arbitration proceedings.
His litigation work on behalf of clients covers all aspects of the litigation process. This includes conducting thorough pre-litigation investigations to build strong cases from the outset, drafting comprehensive pleadings that effectively present client positions, managing the discovery process to ensure that relevant evidence is identified, obtained, and analyzed, and preparing and examining witnesses to ensure they are well-prepared to provide credible and compelling testimony.
In patent litigations, he conducts claim construction, interpreting the language of patent claims to determine their scope and meaning, which is crucial in patent litigation and he routinely handles Markman hearings.
His expertise extends to handling pretrial motions, where he effectively advocates for clients to secure favorable rulings before trial. He is highly successful at handling summary judgment motions, frequently resolving cases or narrowing issues without the need for a full trial.
In court, he presents and argues motions, articulating clear and persuasive legal arguments to support clients’ positions. He also prepares detailed legal briefs, providing thorough and well-reasoned support for the arguments made in court. His comprehensive approach to litigation ensures that clients receive vigorous and effective representation at every stage of the legal process, including while drafting comprehensive case-ending settlement agreements.
Prior to entering legal practice, Alan worked as a design engineer for a major semiconductor manufacturer.
